Personal Data Protection Law (KVKK) Clarification Text
1 Introduction and General Information
As [SERVERPLANCE BİLİŞİM VE TELEKOMÜNİKASYON HİZMETLERİ LİMİTED ŞİRKETİ] (hereinafter referred to as the "Nevihost Bilişim Hizmetleri" or "[Nevihost]"), we attach great importance to the personal data of our valued customers ("Customer") and the privacy of their private lives. Personal data obtained within the framework of privacy of private life and respect for fundamental rights and freedoms are processed by our Company under the conditions explained below in accordance with the Personal Data Protection Law No. 6698 ("KVKK").
Processing of personal data in accordance with KVKK refers to all kinds of operations performed on data, such as obtaining, recording, storing, preserving, changing, reorganizing, disclosing, transferring, taking over, making available, classifying or preventing its use, completely or partially automatically or by non-automatic means provided that it is part of any data recording system.
2 Collected Personal Data and Method of Collection
In order to benefit from our services within the context permitted by the legislation, the following data declared by you in the membership form when registering on our site or generated during your use of the system are collected by our Company:
- Your name, surname and company title,
- Your T.R. Identity number and Tax identification number,
- Your billing, delivery and residential address information,
- Your phone numbers and e-mail addresses,
- Your payment and billing current information,
- Website access, log and traffic information (IP address, port, session information, etc.),
- Traffic and log information required to be kept as a hosting provider within the scope of Law No. 5651,
- Your support requests (tickets), e-mail correspondence and call center phone call records,
- Interactions you perform via our social media accounts.
Your personal data is collected directly through your declaration in physical, electronic or verbal environment for the fulfillment of our legal obligations, the performance of the distance sales contract between our Company and the customer, and legitimate reasons stipulated in the laws.
3 Purposes of Recording and Processing Personal Data
Your collected personal data will be processed in the following processes within the personal data processing conditions and purposes specified in Articles 5 and 6 of the KVKK:
- Providing and activating ordered hosting, server, domain and software services,
- Execution of pre-sales and post-sales technical support operation processes and ensuring communication continuity,
- Fulfilling our legal obligations as a hosting provider arising from Law No. 5651 and related legislation in full,
- Keeping financial, legal and accounting records, carrying out billing transactions,
- Increasing our service quality, conducting performance analysis and making infrastructure improvements,
- Confirming the identity information of the transacting party in financial and technical transactions posing a risk,
- Providing information and documents requested by judicial, administrative and law enforcement authorities as required by legislation,
- Sending periodic campaign, newsletter and service announcements provided that you have explicit consent.
4 To Whom and For What Purposes Personal Data Will Be Transferred
Your personal data may be shared with authorized institutions and our business partners in accordance with Articles 8 and 9 of the KVKK:
- Payment Service Providers: Name, surname, invoice and amount information are transferred to relevant contracted banks and virtual POS infrastructure providers for collection and refund transactions in credit card and wire transfer payments. (Your credit card information is strictly not stored in our systems).
- Official Authorities and Bodies: Within the scope of legal obligations, BTK (Information and Communication Technologies Authority), EGM (General Directorate of Security), Public Prosecutor's Offices and Courts.
- Domain Name Registration Authorities: National and international registration authorities (ICANN, TRABIS, etc.) in domain registration and transfer processes.
- Financial and Legal Advisors: Contracted financial advisory and law firms for tax returns, accounting processes and audits.
5 Rights of the Personal Data Owner under KVKK and Application
In accordance with Article 11 of the KVKK, as a data owner, you have the following rights:
- To learn whether your personal data is processed, to request information if it has been processed,
- To learn the purpose of processing your personal data and whether they are used in accordance with their purpose,
- To know the third parties to whom your personal data is transferred domestically or abroad,
- To request the correction of your personal data if it is incomplete or incorrectly processed,
- To request the deletion or destruction of your personal data within the framework of the conditions stipulated in Article 7 of the KVKK,
- To object to the occurrence of a result against you by analyzing the processed data exclusively through automated systems.
